Waterproofing failures and leaks are a very common and frustrating problem in apartments! Hearing about a 30-40 thousand expense and the need to demolish the entire bathroom suggests this is a serious matter. Typically, the responsibility for the bathroom's waterproofing lies with the upper floor tenant/owner. However, it is best to immediately check your Building Society Bylaws (or HOA rules). Until liability is confirmed, avoid making any partial payment, as this is often considered a structural issue!
